A Judge once remarked to another attorney “Roy is not afraid of  a good fight, in fact, trial is the closest thing he can find to combat without getting shot at.” 

I took that Judge’s comment as a true compliment, not to myself but to my parents who taught me to work hard, never quit, and always defend those who cannot defend themselves (Semper Vallo).  It is also a testament to many years spent in the Marine Corps, including multiple combat tours.

After a few years in the Marine Corps, college was easy.  While enrolled at the University of Arkansas at Little Rock, studying Criminal Justice, I maintained duties as a Mortar Section Leader with India Company, 3rd BN, 23rd Marines training at Camp Robinson, AR.  At UALR I completed 83 Semester hours of college credit in fifteen months before being accepted to Baylor Law School for the Spring Class of 1998.

Following graduation from Baylor Law and passing the Texas Bar exam in 2000, The Law Office of  Roy L. Reeves was opened in Kerrville, Texas.  I picked my first first Felony Jury in the early Spring of 2001 in front of the same Judge quoted above. 

The Law Office of Roy L. Reeves served clients from Kerrville to Killeen with offices in both cities until the the deployment of troops from Fort Hood in support of the Iraq war.  With my main client base deployed, I joined the firm of DeHay & Elliston, L.L.P. in Dallas, Texas where I began working on multi million dollar complex litigation cases involving, premises liability, product defects (building products and pharmaceuticals), and toxic torts. 

The Law Office of Roy Reeves was resurrected in 2007 as Reeves Law Firm, P.C. providing the same quality representation and litigation experience to the public in Collin, Dallas, and Denton Counties that was previously reserved for several Fortune 50 companies. 

DWI/DUI

It is never okay to drink and drive and at the Reeves Law Firm clients are encouraged to abstain from alcohol, take a taxi, or pick a designated driver. 

However, if you have been charged with a DWI or DUI, you should know the penalties you are facing.  Specifically, a first offense can result in up to 180 days in jail, a fine up to $2000, and 100 hours of community service.  

Subsequent convictions for DUI/DWI carry punishments of up to 10 years in prison, a $10,000 fine, and 600 hours of community service.

Time is not on your side

A common mistake when arrested for DWI or DUI is to assume that since the magistrate let you go on bail, you don’t need an attorney until your case is called for trial.  WRONG!  You have only 15 days from the date of arrest to request a hearing on your driver’s license. If you fail to request a hearing, your license may be suspended and you face the probability of paying huge fines for several years.

It is important that you hire legal representation immediately.  You need an attorney at this hearing to challenge the license suspension.  Additionally, your Attorney can use this license hearing as an opportunity to question the arresting officer.  Putting the officer on the stand helps to establish his or her position, which can be very beneficial to your criminal case later on.

Regardless of whether it is a first, second or third offense, the Texas Department of Public Safety has the authority to levy a surcharge on driver’s licenses suspended for alcohol related arrests.  This charge can range from $1,000.00 to $2,000.00 per year for three years.  Furthermore, if you are convicted of a DWI or DUI, you may be ordered to attend alcohol counseling, alcohol treatment, and/or have a device installed on your car that requires a breath sample before it will allow you to start your car, and you will pay higher insurance premiums for your car.  If you damaged someone else’s property, expect to pay for that damage as well.

As you can see, the slogan “Don’t mess with Texas” has extra meaning if the charge is driving while intoxicated of driving under the influence of alcohol or drugs.  DWI/DUI is serious business, and if you find yourself charged with this offense, you owe it to yourself to secure the best legal counsel you can get and you need that counsel sooner rather than later.

Range of Punishment for DUI or DWI Conviction in Texas

First Offense:

Fines not to exceed $2,000
Minimum 72 hours in jail (6 days if you are found with an open container) and you can go to jail for up to six months
License suspension for up to one year, which may be waived if you attend a DWI Education course
Community service of not less than 24 hours nor more than 100 hours

Second Offense:

Fines not to exceed $4,000
Minimum 72 hours in jail (6 days if you are found with an open container) with a maximum of up to one year
License suspension for not less than 180 days nor more than 2 years
Community service of not less than 80 hours nor more than 200 hours
Expect to pay for a deep lung device to be installed in your vehicle

Third Offense:

Fines not to exceed $10,000
Minimum 72 hours (6 days if you are found with an open container) and the Judge can sentence you to jail time up to one year
License suspension for not less than one year
Community service of not less than 180 hours nor more than 600 hours
Expect to pay for a deep lung device to be installed in your vehicle

In addition to the criminal punishment set out above, the Legislature has mandated a “surcharge” to be levied on all persons convicted of DUI/DWI in Texas.  The surcharges are:

1st Conviction

$1,000/year for 3 years ($3,000)

2nd Conviction

$1,500/year for 3 years ($4,500)

3rd Conviction

$2,000/year for 3 years ($6,000)
Any conviction with a BAC of 0.16 or more
